Thank you for your interest in generating a unique artwork based on paintings by Scott Naismith (the “Experience”) to be printed onto a bottle of Johnnie Walker Blue Label (“the Product”).

These terms of use (the “Terms”) are a legal agreement between you (“you”) and Diageo Scotland Limited (registered in Scotland with company number SC000750 and registered address at 11 Lochside Place, Edinburgh, Scotland, EH12 9HA). (“Diageo”, “us”, or “we”) in respect of your use of the Experience.

By proceeding with the Experience you agree to these Terms. If you do not agree to these Terms, we do not grant you permission to continue with the Experience.

You must be at least 18 years old in order to participate in the Experience.

You acknowledge that all Intellectual Property rights in the Experience, Scott Naismith’s paintings and the Product anywhere in the world are owned by, or licensed to, us. You agree that you are permitted to use this material and/or content only as set forth in and to the extent permitted by these Terms. You agree that you shall not acquire any intellectual property rights in the Product as part of your participation in the Experience.

Unless otherwise indicated, we are the owner and/or authorised user of all trade marks, service marks, design marks, trade dress, patents, copyrights, database rights and other intellectual property (collectively, the “Intellectual Property”) appearing on or contained within the Experience and the Product. Except as provided in these Terms, your use of the Experience and purchase of the Product does not grant you any right, title, interest, or license to any such Intellectual Property.

Except as expressly authorized by law, by us, or by the applicable licensor in writing, you are not entitled to reproduce, or to create derivative works of the Product, or to use it, including any Intellectual Property rights in the Experience, for commercial purposes.

This Experience is provided “as is,” and your use thereof is at your own risk. We and our officers, directors, employees, agents and assigns disclaim, to the fullest extent permitted by law, any and all express and implied warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose, performance, title, and non-infringement. We do not warrant that the Experience will be free from viruses, available, accessible, error-free, uninterrupted, or that the content produced will be accurate. If you are dissatisfied with the Experience, your sole remedy is and shall be to discontinue using it.

We only provide the Experience for domestic, personal and private use. You agree not to use the Experience for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Our maximum total liability under or in connection with these Terms whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to £250. Nothing in these Terms will limit or exclude our liability for (a) death or personal injury resulting from our negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other liability that cannot be excluded or limited by English law.

Nothing in these Terms restricts any legal rights you may have as a consumer and your purchase of the Product will be subject to our terms of sale and applicable consumer law.
